By renting a vehicle, you accept these general rental conditions as an integral part of the contract binding you, as the lessee of the vehicle, with Vespa Location.
The renter will have the vehicle for the rental period specified in the rental agreement. Failure to return the vehicle at the time indicated on the rental agreement constitutes a violation of the conditions of the rental agreement. In case of return one hour later than specified in the rental contract, Vespa Location reserves the right to charge an additional day.
5.1. All reservations are payable in full when booking. If payment is not received 30 days before the start of the rental, Vespa Location reserves the right to treat the reservation as canceled and will charge a fee – see Article 15.
5.2. The model of the vehicle will be defined in the rental contract. The images and descriptions of the vehicles on the website www.locationscootermenton.fr and on the printed media are representative of the vehicles available, but are not necessarily the vehicles specified on the rental contract. Vespa Location reserves the right to correct errors online or in print at any time.
5.3. Vespa Location makes every effort to ensure that renters drive the desired vehicle. Unforeseen and uncontrollable situations may however arise and require the substitution of a motorcycle such as mechanical breakdowns, damage due to collisions or theft. If such a situation should arise before the rental, the renter will receive a refund or a comparable rental vehicle.
5.4. If the rental demand exceeds the supply of vehicles, Vespa Location will offer the lessee to transfer the rental contract to another provider. If the tenant agrees, the first rental agreement will end and the tenant will conclude a new rental agreement with the service provider mentioned. In case of disagreement, Vespa Location will terminate the rental agreement according to the rules for cancellation of the rental agreement.
6.1. Before signing the rental contract, the renter and Vespa Location will check the condition of the vehicle and the tires together. By accepting the condition of the vehicle and the tires, the hirer cannot claim any compensation due to a malfunction of the vehicle or the tires.
6.2. The lessee agrees to return the vehicle in the same apparent, technical and operating condition.
7.1. To avoid theft, the renter must always take care of the vehicle and its keys. The renter must only leave the vehicle in secure car parks and use all the anti-theft devices provided with the vehicle.
7.2. The renter must always protect the vehicle against bad weather which can damage the vehicle.
7.3. The renter must use the gasoline and oil indicated for the vehicle.
7.4. The lessee must not sell, rent or dispose of the vehicle or its spare parts.
7.5. The tenant must inform Vespa Location without delay and at the latest within 24 hours, if he becomes aware of a defect in the vehicle. The vehicle must be returned to Vespa Location in Menton, France for any regularly scheduled adjustments, repairs or servicing. The renter must not let anyone intervene on the vehicle or modify it without authorization from Vespa Location. Subject to authorization of the interventions by Vespa Location, the latter will reimburse the tenant for the costs incurred on production of an invoice in good and due form. Failing this, the renter will be responsible for all the expenses of Vespa Location necessary for the repair of the vehicle or for its compliance with the applicable regulations.
7.6. For rental periods of more than one week or more than 2000 km, the lessee must carry out routine maintenance of the vehicle every 500 km (checking the oil level, coolant, tire pressure, chain tension & lubrication).
7.7. The tenant must comply with legislation relating to passports, visas, driving licenses and remains responsible for all consequences in the event of non-compliance.
7.8. The tenant must comply with all national traffic rules and remains solely responsible for fines, fines, reports and customs proceedings against him.
Vespa Location maintains vehicles at least according to the standards recommended by the manufacturer. Vespa Location assures the renter that the vehicle is in good working order and suitable for rental at the start of the rental period.
9.1. Vespa Location will charge the rental rate before the start of the rental. At the time of delivery of the vehicle Vespa Location will request a debit authorization from the provider of the renter’s bank card for the security deposit.
9.2. If the vehicle is returned undamaged and no other property has been damaged during the rental, the security deposit will not be charged to the renter’s credit card.
9.3. If the vehicle is returned damaged or missing parts, the security deposit will be retained in part or entirely by Vespa Location. In addition, an administrative fee of €50 applies to any damage or missing parts of the vehicle.
10.3. When driving Vespa Rental motorcycles, renters must put on adequate and standard helmets. For the safety of the renter, Vespa Location strongly recommends putting on adequate clothing such as motorcycle jackets, pants, gloves, boots, etc. Vespa Location is not liable for damages resulting from the acts of the tenant which may cause injury, death or any other damage to the tenant, his property, his family, his heirs or transferees.
11.2. Vespa Location vehicles must be driven exclusively by the signatories of the rental contract. The vehicle is not transferable and is only valid for the duration indicated on the rental agreement and the persons stipulated on the rental agreement.
12.1. In the event of theft or damage to the vehicle, the tenant must inform Vespa Location without delay and at the latest within 24 hours of the incident.
12.2. If the vehicle is involved in an accident, the renter must never accept or declare any responsibility on his part. The tenant must obtain the contact details (names and addresses) of all the people involved in the accident as well as the witnesses. The renter must also secure the vehicle and report immediately to the Police if anyone is injured or if there are disagreements of responsibility.
12.3. The renter agrees to inform Vespa Location without delay and no later than 24 hours after the accident. The tenant must send to Vespa Location by registered letter, a photocopy of the accident report duly completed and signed by both parties (circumstances of the accident, identities of the people involved in the accident, contact details, etc.)
12.4. Vehicles are provided with breakdown service. In the event of a breakdown, the tenant must inform Vespa Location without delay and at the latest within 24 hours.
13.1. Vespa Location offers rental equipment such as luggage storage, navigation systems and helmets. Any equipment provided to the renter by Vespa Location not returned or returned in damaged condition will be charged to the renter.
14.1. If the renter cancels the reservation between 90 days and 7 days before the start of the rental, Vespa Location will retain 30% of the total rental price. If the tenant cancels the reservation less than 7 days before the start of the rental, Vespa Location will retain 100% of the rental price. There are no exceptions to this rule.
14.2. In the event of cancellation by Vespa Location, all payments that the renter has made or the reservation will be transferred to a later date.
14.3. Vespa Location is not required to reimburse the renter once the rental has started regardless of the reasons given by the renters. In particular, Vespa Location cannot be held responsible for bad weather.
If these conditions are not met, Vespa Location may retain the booking regulations plus an administrative fee of €50.
No verbal modification of the rental contract will be valid. Only the written contract is valid. If any part of the rental terms and conditions becomes void, this does not invalidate the rest of the rental agreement.
17.1. Any photo created by Vespa Location or its representatives belongs to Vespa Location. The copyright belongs to Vespa Location. Vespa Location may use these documents for advertising or marketing purposes without the possibility of complaint from the hirer.
17.2. Vespa Location will retain the renter’s personal information to perform this rental agreement. Data collection is declared to the CNIL (Commission Nationale de l’Informatique et des Libertés) in France. In accordance with the “Informatique et Libertés” law of January 6, 1978, you have a right of access to information concerning you and the right to request its rectification or deletion by contacting Vespa Location – see Article 1.
